General terms and conditions of business
- 1 Scope
The following terms and conditions are an integral part of every contract concluded between us, Madras Carry UG (limited liability), Bückeburger Str. 50, 28205 Bremen, and you via our online shop.
- 2. Conclusion of contract; delivery
(1) The presentation of our goods on our website www.madras-carry.com.de does not constitute a binding offer on our part.
(2) We deliver internationally; you can find a detailed description of the countries we deliver to here.
(3) We reserve the right to make partial deliveries, provided this is reasonable and necessary for prompt processing.
- 3 Our Liability
Our goods are subject to the statutory warranty rights for defects, unless otherwise agreed below:
(1) We shall be liable – regardless of the legal basis – for damages or reimbursement of futile expenses in accordance with the following provisions under letters (a) and (b):
(a) In cases of intent and gross negligence, we are liable without limitation. In cases of simple negligence, we are only liable for damages resulting from a breach of a material contractual obligation (an obligation whose fulfillment is essential for the proper performance of the contract and on whose compliance you regularly rely and may rely); in this case, however, our liability is limited to compensation for the typical, foreseeable damage.
(b) The exclusions and limitations of liability resulting from point (a) shall not apply insofar as we have fraudulently concealed a defect or assumed a guarantee for the quality of the goods, for damages resulting from injury to life, body or health, as well as in the case of liability under the Product Liability Act.
(2) To the extent that our liability is excluded or limited, this also applies to the personal liability of our legal representatives and vicarious agents.
- 4 Retention of title
The goods remain our property until full payment is received.
- 5 Consumer dispute resolution
We do not participate in dispute resolution proceedings before a consumer arbitration board and are not obliged to do so.
Customer information
- Select products, add them to the shopping cart, and make corrections.
In our online shop, you can select products from our range and add them to a virtual shopping cart by clicking the "Add to cart" button. You can view your shopping cart at any time via the "Check out" link or the shopping cart icon. You can change the quantity of selected products in the shopping cart at any time by clicking the corresponding button or by changing the quantity and then clicking the update button.
- Enter your data / Register
Clicking the "Checkout" button will take you to the page where you enter your information. Here you can register with us as a new customer. If you are already registered, you can log in here with your email address and password. After entering your information or logging in, you can enter or verify your shipping and billing address and select your preferred shipping method (currently only standard shipping).
- Shipping method
We offer shipping via DHL GoGreen or GLS. Click the "Proceed to payment method" button to select your preferred option.
- Choose payment method
Next, you can select your preferred payment method. We offer the option to pay via PayPal or credit card. Make your selection by clicking the drop-down menu next to the respective payment method. Then click the "Review Order" button to proceed to the order summary.
- Order summary and order completion
Here you will find an overview of the items you have placed in your shopping cart, the total costs, your delivery address, and payment method. Please check that all information is correct. By clicking the "Place order" button, you are submitting a binding offer to purchase the goods currently in your shopping cart and sending your order to us.
- Order confirmation
For your information, you will receive an order confirmation by email, which lists your order again; this email does not yet constitute acceptance of your offer, but serves solely to inform you that your order has been received by us.
- Conclusion of contract
The presentation of our goods in our online shop does not constitute a binding offer on our part. By placing an order, you are submitting a binding offer to us. When a contract is concluded between you and us depends on the payment method you choose.
If you choose the payment option "Credit Card", a contract between you and us is concluded when you have completed the payment process with your credit card provider. If you choose the payment option "PayPal", a contract between you and us is concluded when you have completed the payment process with PayPal.
- Payment methods
When ordering through our online shop, we offer you two ways to pay for your goods:
1. Pay with PayPal
If you selected "PayPal" as your payment option during the checkout process, you will be redirected to the PayPal website immediately after completing your order. Please log in there and follow the PayPal instructions.
2. Pay by credit card
If you selected the "Credit Card" option during the ordering process, you will be redirected to your credit card provider's website immediately after completing your order. Please log in there and follow the instructions.
- Storage of the contract text
We save the contract text and send you the contract documents by email. If you have registered with us as a customer, you can also view your order on our website after logging in.
- Statutory warranty for defects
All products that you can order in our online shop are subject to statutory warranty rights, unless otherwise stipulated in § 3 of our terms and conditions.
- Contract language
The contract language is German.
- Complaints/Online Dispute Resolution
Should you have cause for complaint, you can submit your complaint on the European Commission's online dispute resolution website. Your complaint will then be forwarded to us. Please follow the link below and follow the instructions there:
